Case ICA-2023-01: Appeal lodged by Tag Heuer Porsche Team against Decision No. 10 dated 29 July 2023 of the Stewards of the event held in London (United Kingdom) counting towards the 2022/2023 FIA ABB Formula E World Championship

On 29 July 2023, the Stewards received two reports (documents No. 3 and 4) from the FIA Technical Delegate, stating that the front right tyre pressure of Antonio Felix Da Costa’s car (Driver No. 13 of Tag Heuer Porsche Team) was under the minimum value given by the Tyre Supplier, from lap 33 to chequered flag. The Stewards considered that the non-respect of the front right tyre pressure was a breach of Article 25.11 of the 2022/2023 FIA Formula E World Championship Sporting Regulations. They decided to impose a 3 minute-time penalty to the Driver Antonio Felix Da Costa.

On 2 August 2023, Tag Heuer Porsche Team decided to appeal this decision.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions, decided to declare the appeal inadmissible.

The International Court of Appeal was presided over by Mr Nish Kumar SHETTY (Singapore), and included Mr Luigi FUMAGALLI (Italy), Mr Jean GAY (Switzerland) and Mr Javier MARTIN MERINO (Spain).
